HOP Terms of Service

These terms set out the rules for using the HOP app and related services provided electronically, in accordance with the Polish Act of 18 July 2002 on providing services by electronic means.

This English version is provided for convenience; the Polish version is legally binding.

§ 1. Provider

The provider is Appifi Sp. z o.o., Tylna 2D/41, 90-346 Łódź, Poland, entered in the National Court Register (KRS) under number 0001150929, NIP (VAT) PL7252351636, REGON 540700682, share capital PLN 5,000. Contact: kontakt@hop-app.eu.

On the App Store the app is published from the Apple developer account of Rafał Mirowski, CEO of Appifi Sp. z o.o., on behalf of the provider. Appifi Sp. z o.o. remains your contracting party for HOP.

§ 2. Definitions

§ 3. Services

  1. The App lets you exchange text messages and photos, post announcements to people nearby and send SOS alarms — over the Mesh network and, with the internet on, also via the Relay.
  2. Using the App and the Relay is free of charge. The App has no ads and no paid features. Data and SMS costs are borne by the User under their agreement with their carrier.
  3. The service agreement is concluded when the App is installed and started, for an indefinite period. The User may terminate it at any time by deleting the App.
  4. The App requires no account and no contact details.

§ 4. Technical requirements

You need a phone with Android 8.0 or later or iOS 17 or later, with Bluetooth and Wi‑Fi. Internet features require internet access, the SOS position a GPS receiver, and SMS SOS a SIM card. On iOS the connection to nearby phones works over a shared Wi‑Fi network and, between iPhones, also over Apple’s peer-to-peer Wi‑Fi; on iOS the App does not use Bluetooth, and the system pauses connections while the App is in the background.

§ 5. Rules of use

  1. The User shall not provide unlawful content, in particular content infringing the rights of others, inciting violence, harassing, containing sexual material involving minors, or spam.
  2. Sending false SOS alarms, disrupting the Mesh network or the Relay and attempting to bypass security are prohibited.
  3. “Nearby” announcements and SOS alarms to everyone are public. The User should not include private data in them.
  4. The Provider does not know the content of private messages (end-to-end encryption) and does not moderate them. The User can block a person they don’t want to hear from.

§ 6. SOS and safety

  1. The SOS feature helps notify people nearby and chosen contacts. It is not an emergency service, does not connect to the emergency services and does not replace the 112 emergency number.
  2. Delivery of messages and alarms depends on other phones with the App being present, their settings, battery, radio conditions and the operating systems. The Provider does not guarantee delivery or delivery time.
  3. When life or health is at risk, always call 112 if you can.

§ 7. Liability

  1. The Provider makes efforts to keep the App and the Relay working correctly and securely, subject to technical breaks. The App is provided free of charge, as is.
  2. To the fullest extent permitted by law the Provider is not liable for damage resulting from non-delivery or delay of messages, content sent by Users or acts of third parties. This limitation does not apply to damage caused intentionally or to consumer rights that cannot be excluded by contract.

§ 8. Intellectual property

The App, its design, logo and the HOP name are protected by law. The Provider grants the User a non-exclusive, free licence to use the App for their own needs for as long as they use it. The Bricolage Grotesque and Martian Mono fonts are used under the SIL Open Font License 1.1.

§ 9. Complaints

  1. Complaints about the App or the Relay can be sent to support@hop-app.eu or by post to the Provider’s registered office.
  2. A complaint should describe the problem, the phone model and App version, and a reply address.
  3. The Provider handles a complaint within 14 days of receipt and replies to the address given by the User.
  4. Consumers may use out-of-court dispute resolution, e.g. the help of a local consumer ombudsman.

§ 10. Personal data

Data processing is described in the Privacy Policy.

§ 11. Changes and final provisions

  1. The Provider may change these Terms for important reasons (changes in law, new features, security). Changes are announced on hop-app.eu at least 14 days in advance; a User who disagrees may delete the App.
  2. These Terms are governed by Polish law. This does not deprive consumers of the protection granted by the law of their country of habitual residence.
  3. These Terms apply from 3 October 2026.
